Darwin Kruse was a construction worker. He was injured while working for the Coos Head Timber Company. Subsequent to the accident, Kruse signed an agreement with his employer that granted Kruse compensation in exchange for his promise not to sue.
Kruse is now trying to have the agreement voided. Evidence introduced proved that Kruse had an IQ of 83 and that he dropped out of school at age 18.
When he dropped out of school, he was in the eighth grade but was doing less than sixth grade-level work. Will Kruse's "slowness" necessarily invalidate the contract? Explain.
Kruse v. Coos Head Timber Co., 432 P.2d 1009.
