Mers was arrested and charged with a felony. Dispatch Printing, his employer, told him that he had to be suspended. However, Mers was also told that he could return to work if the case against him was resolved in his favor.

Relying on this promise, Mers did not seek other employment. The case ended in a hung jury, and Mers reported back to work. Dispatch Printing, however, refused to let him work or pay him any back pay.

In a suit against Dispatch Printing, what legal argument might Mers use to compel Dispatch Printing to pay him for any losses due to his reliance on the promise to let him return to work when the case ended in his favor? Explain.
