Question: What is the difference between using tort law to protect the environment and using statutes and regulations? Using tort requires governmental agency involvement while statutes only allow change through the courts. There is no difference. Both methods have the same result, a change in the way a business (or person) interacts with the environment. Using tort is no longer possible. Statutory processes are the only available conflict resolution process. Using tort requires damage and litigation before change can be made while statutes allow some agencies to use various methods without sanctioning. Using tort allows for quick resolution while using statutes requires a long regulatory process.
