Question: A new federal program administered by USDA provides funds to install water wells for livestock belonging to qualified farmers. Richard Kimble, a wealthy doctor who always dreamed of being a farmer after once visiting his grandparents' farm, recently bought some land in Northampton County, NC with dreams of one day establishing a cattle operation. He applied for funds at the local Farm Service Agency (FSA) office to install a livestock water well and was denied. Though his denial letter informed him he could appeal the decision to the USDA National Appeals Division, he felt he could do better with an urban jury and filed suit against USDA in the U.S. District Court for the Eastern District of North Carolina in Raleigh. The USDA filed a pre-trial motion to dismiss the case, which the court grants. Why does the USDA succeed? Question 9Select one: a.
