Question: A candidate in the Democratic primary election for the municipal council in Ridgefield, New Jersey, withdrew. A petition nominating Michael Madden was prepared, but because Madden was a student at Purdue University in Indiana he was not in New Jersey to sign the nomination acceptance.

He signed the acceptance in Indiana and faxed it to New Jersey where it was properly and timely filed with the borough clerk. The clerk said the acceptance was defective because of the "facsimile" signature and refused to certify Madden as a candidate. Using principles of contract law, what is your opinion about the faxed document?
