For the Malik v. Caldwell case that you read last week there are two types of damages requested by the plaintiff: reliance damages in the amount of $26,000 or receiving the benefit of the bargain by forcing the sale of the property. The sale of the property strikes me as something that the judge might not be willing to force. Assume that you were retained by Malik's attorney to actually quantify "benefit of the bargain" damages for Malik. Benefit of the bargain in this case would be the amounts that Malik would have made from the purchase, redevelopment and sale of the Caldwell property.
Write a document -- likely a page or less -- that describes what data you would want from Malik to support your calculation of the benefit of the bargain damages and reliance damages.
Things to consider:
How would he have used the property?
How long would it have taken to develop?
What costs and revenues were required?
What about the riskiness of the investment?
