In his will, Gavegnano left all his tangible personal property to his daughter, Caroline. At the time of his death, he owned 19 thoroughbred horses. In addition, a cashier's check made pay able to him for $33,000 was found among his belongings. The lower court judge held that the horses and the check were tangible personal property and should be given to Caroline under the terms of the will.

Caroline's brothers appealed the decision, claiming that neither the horses nor the check were tangible personal property. Were Caroline's brothers correct? Explain.
