My business in natural skincare products uses ingredients formulated from organic raw materials and is therefore governed by FDA regulations; a disclaimer of warranty, a return and refunds policy are the two statements that will be necessary for my sales.

According to the Food and Drug Administration (FDA), it is the manufacturer's and/or distributor's responsibility to ensure that a product is labeled properly; failure to comply with labeling requirements may result in a misbranded product according to the FDA; misleading or failure to state material facts on the cosmetic product is one form of misleading labeling (The Food and Drug Administration, 2017).

The FDA requires the business owner to include statements like: “manufactured for” or “distributed by” on the informational label, that is if the business owner is not the product manufacturer; statements that may imply that a cosmetic product can cure, treat, prevent or diagnose a problem without approval from the Food and Drug Administration (FDA) is against the regulations; cosmetics are not categorized as drugs.

My first product - 100% natural age-defying moisturizer has the following information on the label:

Recommended use: when to use the product and how often

Ingredients

Expected results: soften and minimizes the appearance of wrinkles, improves skin tone and firmness, leaves satin finish and youthful look etc.,

Safety precautions: All products are for external use only. Keep out of reach of children

Based on the product description and label information, my disclaimer of warranty statement should read as follows: the above statements have not been evaluated by the FDA; this information is for educational purposes only, this product is not intended to treat, cure, prevent or diagnose any disease of conditions, nor is it intended to be prescribe in any way.
