Sosa Crisan, an 87-year-old widow, collapsed and fell unconscious while shopping at a local grocery store. The city police took her to a city hospital where she was admitted. She remained there fourteen days, after which time a family member came forward and had her transferred to a private hospital. She died some eleven months later without ever regaining consciousness. After her death, the city sued Crisan’s estate to recover the city’s expenses of providing her with the ambulance service and her stay in the city’s hospital. Clearly this unconscious woman made no agreement with the city. Therefore, was there a contract between Sosa Crisan and the city? Explain the basis for the city’s right to recover in this case, if any.
