Question: The parents of Lance Nelson, a minor, hired Challoner McBride to represent Lance in a lawsuit against his school. Lance's mother signed a contingent fee agreement giving McBride a 331 ⁄3 percent fee. Two and a half years later, McBride filed suit. There was a series of dismissed suits because McBride did not follow proper procedure.

Five years after being hired, McBride filed a fourth complaint which the trial court dismissed, but a year later the appellate court upheld it. Lance, then of age, fired McBride and hired Daniel Whetter who eight months later settled Lance's claim for $47,400. McBride sued claiming a contractual right to one-third of the settlement. Did she have such a right?
