The Dilemma of Knowing Too Much
Assume that the personnel director has given you the responsibility for interviewing job applicants to eliminate all but the top three candidates. Several times during casual conversation, the personnel director has commented that the worst candidates are young, newly married women, because they are the most likely to become pregnant and take maternity leave. Although you do not ask candidates if they are married or if they have or intend to have children (because you know that the question is illegal), you establish a good rapport with a highly qualified candidate, who voluntarily tells you that her new husband is very eager to "start their family." Laughingly, she says that she has given too much personal information about herself and returns to her qualifications for the job. After conducting all the interviews, you decide that she is one of the top three candidates. Are you going to include her in your recommendations to the personnel director? Why or why not? Are you going to tell the personnel director what you learned about this woman's personal life? How can you handle this situation legally without betraying the trust of the personnel director?
