What would you as the hospital administrator do in the following situation?

A patient decides to disconnect himself from telemetry and leave the hospital for 4 hours to go score some cocaine on the street.

Upon return to the hospital, the patient enters through the emergency room. The physician begins yelling at the patient for walking through his ER and threatens to contact security. The patient reacts by acting like he is going to hit the physician in the face, but instead the physician hits the patient first.

Upon discharge, the patient claims that the hospital was negligent via respondeat superior for the physician's actions and decides to pursue legal action.
