Question: I am driving down the road late one night and witness a car accident in which the man inside the car is pinned inside the vehicle. To make matters worse, his car is sinking into thick mud which will soon cover the whole car. I approach the driver's window and ask him if he has his checkbook in the car. He says he does. I promise him that if he writes me a check for $25,000, I will tow his car out of the mud. Desperate, he agrees and writes me the check. The next day, he stops payment on the check. I sue him for breach of contract. What will the result of this lawsuit be? Why?
