Question
Mary and Alan Shot have just been blessed by the birth of a healthy baby daughter, Faith. They live in Hope in the mythical state of Moldavia, a small town of 5000 with one pediatric group. The practice consists of three pediatricians, two Physician Assistants, two nurses, two billing clerks, a scheduler, and an office manager/desk supervisor.
Mary and Alan moved from Capital City, Moldavia where Faith was born six months ago and she has not gone to a pediatrician since her two-week check-up. It is 150 miles from Hope and is the closest community with pediatric offices.
The Hopes immediately schedule an appointment at the Hope Well Being Pediatric Group and bring Faith in for her six-month checkup.
At the appointment, one of the Physician's Assistants, Sterling Kind weighs and measures Faith. He then indicates that he is prepared to provide Faith with her first immunizations including a COVID vaccine. The Shots decline and suggest that they do not want their child to have any type of immunization. They immediately leave the appointment before a Doctor can perform a follow-up.
You are the lawyer for the practice and are contacted to offer advice on whether and how the Practice is to address this matter. In your evaluation research, identify the inoculation laws of the state where you live or practice.
1. Should the Practice be permitted to terminate its relationship with the Shots?
2. What obligation does the Practice owe the Shots? Using the law in the state where you are a resident or work, indicate any notification process that would be required should the practice decide to terminate the relationship with the parent/parents. Be specific
3. What other information would you like to know to advise the Practice?
4. Explain the risks and benefits of a decision to force Faith to leave the practice. Please consider the legal and ethical implications of the decision.
5. After you review these issues please conclude with a recommendation of what the practice should do. In your evaluation research the inoculation laws of the actual state where you live or practice.
