The U.S. society would be affected tremendously if employers could not be held vicariously liable for their employees' torts. Damages in torts cases would be affected the most. If a person could only sue the employee that committed the tort, they are a lot less likely to get the damages needed to compensate for the act done. Being able to sue the employer allows plaintiffs to obtain a higher amount and get justice. Another thing that would be affected is the employer's policies. An employer is less likely to be concerned with the employees that they hire if they are not responsible for their torts. This is because it wouldn't cost them money if their employee committed a tort. The employer is also affected because not being held liable allows for them to save money and possibly keep them from criminal files on their record. This is beneficial for them because it will keep their record clean as long as they do nothing wrong.
