Shiny Company limited, a shampoo manufacturer, offered prizes to customers who could accommodate a certain number of tokens from its shampoo bottles. First prize was a Toyota Camry; second prize was a ‘date with Tom Cruise’. Jenny collected the required number of points and ‘won’ second prize but was informed that Tom Cruise was not available for the date and that no alternative prize would be offered to her.

The conditions of entry stated, in very small print at the base of the shampoo bottles that ‘ it is a condition of entry that it is agreed that entry does not give rise to any legal relationship whatsoever between Shiny company limited and the entrant and that any arrangement is binding in honour only’. Advise Jenny if she can sue Shiny Company limited for damages for breach of contract.
