Paul filed an action against Magazine containing a false statement that plaintiff had bribed a public official in order to obtain a $5 million highway construction contract. Magazine is published in print monthly, and has a circulation of 50,000 subscribers. As a result, Paul's construction business suffered a severe downturn in revenue, as his regular customers did not want to be associated with him any longer.

Magazine did minimal investigation prior to publishing the story because they discovered the information close to a publication deadline, and failed to fully check the facts.
