Joan Thomas sought legal action against her husband Tim Thomas in the form of a domestic protection order after Tim Thomas got physically abusive with her as well as verbally abusive threatening Joan Thomases life. After Attorney Samuel Wait drafted a protection order for Joan Thomas, he and Joan with Tim Thomas and his mother went to a judge to get the order signed. In the Judges chambers the judge listened to Joan and Samuel Wait along with the pleadings against the order from Tim Thomas and his mother. The judge denied the order. After the meeting in the judges' chambers Joan and Tim return to their home and Tim loads his semi-automatic rifle and began shooting at Joan with their two children hiding in their bedroom. Tim had shot in the direction of the children's room lodging a bullet into the bunkbed. Tim continued to follow Joan out of the house into the yard during daylight hours and shooting her four times in the back as she was running away from Tim. Tim watched Joan die after incapacitating her. Tim has been convicted of second-degree murder and has a 10-12-year prison sentence.
