FUNDAMENTALS OF BUSINESS LAW TODAY- CHAPTER 1 A. Maria was fired from her job because of unfavorable comments about the company that she made on her open FACEBOOK account which the company manager discovered. She took this to a state court and lost both at the trial court and on the appeal. Maria would like to bring this to the U.S Supreme Court as a violation of her constitutional rights. Identify the procedure her lawyer must follow and describe what must occur at the U. S. Supreme Court in order for her case to be heard by them. B. You are a member of a union where you work and are very much involved in contract negotiations. The company wants to replace the arbitration clause in the old contract with a mediation clause in the new contract. In fact they are willing to raise the new annual salary by 2% for everyone if this change is made. Explain what the difference is between these two contract clauses. In your opinion, do you think that you should accept or reject this offer and give reasons to defend your position. C. Johnny has a small company in Florida where he also resides. He recently negotiated a business contract in Pennsylvania with a merchant who is a resident of Pennsylvania. Johnny did this because he hopes eventually to move into Pennsylvania. Johnny breaches the contract and the merchant sues him in the Pennsylvania court system. Johnny makes a motion to dismiss because he claims that Pennsylvania has no personal jurisdiction over him because he does not live in that state. Indicate what you think the court will do in this case and state the reasons for your answer.
