Earl Energy Services has many employees and many applicants for every job vacancy. It pays very well in the rural county - better than almost any other employer. The last time that Earl Energy sought applicants for available jobs it received 100 applications, including 80 from men and 20 from women. One of the tests related to the ability to hold a 100-pound barbell over your head for 60 seconds. This would demonstrate physical strength. While 60 of the men were able to perform this task, only 16 of the women were able to do it. The women filed suit for discrimination, arguing disparate impact.

When challenged by the women to explain why lifting a 100-pound barbell is reasonably related to doing the job, Earl said that people are required to lift heavy weights and it is important to know if applicants can do that.
