AIKEN, S.C. (FOX Carolina) - Walmart has agreed to pay $70,000 to settle a disability discrimination lawsuit filed after an employee with a prosthetic leg was denied work accommodations.

Initially, when Luis Quiñones was hired by Walmart in Aiken, he was permitted to use one of the store's electric carts to perform some of his job duties like stocking shelves. However less than a year into the job, Quiñones was told carts were for customers only and was no longer allowed to use one.

Quiñones was denied a reasonable alternative to accommodate his disability, according to the lawsuit, and told he would need to change positions or buy his own electric cart.

When he said he couldn't buy and transport his own cart, Walmart placed him on indefinite unpaid leave. The U.S. Equal Employment Opportunity Commission (EEOC) filed a lawsuit against Walmart for violating the Americans with Disabilities Act.

"Revoking a reasonable accommodation without providing an alternative violates the ADA," EEOC Charlotte District Regional Attorney Melinda C. Dugas said. "The EEOC will continue enforcement efforts to secure compliance on this issue."

In addition to paying the settlement, Walmart offered Quiñones a job at one of its locations in South Carolina. Employees at the Aiken store will also be required to conduct annual training and submit compliance reports to the EEOC.

"The EEOC will aggressively pursue all appropriate avenues of make-whole relief for victims of discrimination," said Nicholas Wolfmeyer, trial attorney for the EEOC. "This often includes advocating for an employee to be reinstated, which will be done in this case."
