In 2006, Congress created the Stolen Valor Act, which made it a crime to falsely claim to have received a medal from the U.S. military. President Bush signed it into law. In 2007, a politician in California, Xavier Alvarez, was indicted under the act and pleaded guilty under the condition that he could appeal his conviction on First Amendment grounds. In August 2010, a federal court in California agreed with Mr. Alvarez that the law violated his rights under the First Amendment to the U.S. Constitution and, so, the Court found that the Stolen Valor Act was unconstitutional. Please provide explanations for the following: Explain why a president must sign a bill that was passed by Congress in order for the bill to become a law. Explain why a duly enacted law can be determined to be unconstitutional by a court. When Congress voted to approve this bill, the Senate voted unanimously in favor of it. Why is this fact important? Do you think that the Senators and the Congressmen and women and the President knew all along that the Stolen Valor Act unconstitutionally restricted free speech?
