The procedural due process guarantees steps will be followed that allows a student the opportunity to seek help for violations before any action is made against them. The minimum due process is required for suspension. This means that the student would have the right to be adequately notified or pending charges or proceedings and the opportunity to be heard during the proceedings.Also, substantive due process would be followed that ensures that the student will not be subjected to inconsistent acts by the school administration.

After the violation, certain steps should be followed. The behavior should be well documented and given to the parents. The student must be given notice of the misconduct and given the opportunity for a hearing. Both may occur immediately after the violation. During the hearing, the student is given an explanation of the evidence. The student may then have the time to tell their side of the story. The parents may be informed by phone of the suspension, followed by written and mailed notification on the day of the violation

Administration should make sure parents and students have a copy of school/district rules. In my district, they are given out in a student agenda with a student and parent signature page and posted on the district’s website.
