Nelson purchased a fee simple in Gillet's land (Lot 1) located at 25 Hopewell Street, Darwin City, and lodged the transfer document for registration on 22 March 2024.
Gerald lodged a caveat over Lot 1 on 21 March 2024. Gerald is the registered owner of the adjoining Lot 2 and claims he is entitled to use a six-metre-wide strip of land on Lot 1 as an alternative access to a nearby road under an easement agreement with Gillet. Gerald has a copy of his easement agreement with Gilled dated 1 May 2020 and insists that Gillet lodged the easement agreement for registration. However, the Northern Territory Land Title Office's current records do not show any registered easements on Lot 1.
Nelson wants to use the alleged easement area as an additional parking area for Lot 1. He is also negotiating with a bank to mortgage Lot 1 to secure a loan to fund his wedding and honeymoon. However, the bank will not lend Nelson any money unless and until he becomes the registered owner of Lot 1.
On 29 March 2024, a neighbour tells Nelson that Gerald lodged the caveat over Lot 1 primarily because he wanted to buy Lot 1 and was furious that Gillet sold Lot 1 to Nelson instead of him.
