An employee works directly for a company, with regular wage and benefits, subject to the employer's workplace rules. Independent contractors provide goods and services under terms specified in a contract. independent contractors are not subject to employer's rules or employment benefits. In the case of Varisco v. Gateway Science and Engineering, Inc. the Court looked at several factors to determine whether the plaintiff was an employee or independent contractor and worker's compensation eligibility.
