A local clothing store advertises a special sale on Saturday in which the first 30 customers may purchase any item in the store at half price. Janet comes in early on Saturday and is told by a sales clerk that she is customer number 25. She's in a hurry trying to find a new dress for a fancy banquet she's attending with her husband that evening. She finds a dress that fits her perfectly, the dress is a little costly but Janet is excited that she's number 25 and will be able to purchase the dress at half price. When she takes the dress to the store clerk so that she can pay for the dress and be on her way, Janet is told by the store clerk that unfortunately she will have to pay the full price for the dress as the store manager has just decided to end the promotion. Janet is furious and knows she only has a few hours until the banquet starts and really doesn't have time to go to any more stores to look for a dress.
Does the store have to honor the advertising sale and let Janet purchase the dress at half price since she was customer number 25 on the day of the sale? With the half price advertisement for the first 30 customers, did the store create a contract? Who do you think the court would side with, Janet or the store?
