Problem

Eskom has entered into a contract (using NEC3 ECC) with a Contractor to extend an existing substation with additional feeder bays and an additional transformer bay.

During excavations to extend the substation platform, the Contractor discovers a huge rock underground in the middle of the area where the transformer and feeder bays are to be placed (no geo-technical report was provide as part of the Site Information or anywhere else in the contract). The Contractor deals with the challenge immediately and procures the additional services and equipment needed to remove the rock.
