Mary applied to be a firefighter. There were 100 applicants, and they all had to demonstrate their physical ability to do the job by picking up a fire hose and running up a three-story staircase at the training tower, rolling out the hose as they go up the steps. They then have to aim the hose and spray water to put out a mattress fire, then pick up a 180-pound dummy and carry that dummy back down the stairs to the fire truck. This has to be completed in five minutes, and has been designed to accurately depict a typical fire and rescue situation. Of the 100 applicants who participated in the test, 10 women and 30 men passed the test. Mary and 12 other women failed the test, and they filed a complaint with the local EEOC intake agency alleging that the test was biased in favor of the male applicants and that the women experienced adverse impact discrimination.
