FACTS - On May 5, David and William, who had been neighbors for three years, argued over David's construction of a ditch, which diverted water onto William's property. William told David to stop construction of the ditch or he "would kill him." The following day, David and William met again in David's garage. Within minutes William became very angry and cut David's leg with an axe he found in William's garage. After cutting David, he panicked and ran home. William attempted to reach a telephone to call for help, but the cut proved fatal, resulting in David's death.
