Dan was stopped by a police officer at a sobriety checkpoint at which officers stopped all cars and asked drivers for their license and registration. When Dan was stopped, the police officers used a flashlight to illuminate contents inside the car. While doing so, the officer found a gun (which they later learned was unregistered) partially wedged inside the passenger seat. They arrest Dan and seize the weapon. At trial, Dan wants to suppress the gun. Is he likely to succeed? Why? Assume the sobriety checkpoint was legal; do not analyze its constitutionality.
