1. Upon his discharge from the Air Force, Sheldon decided to attend college. Because of the expense of housing, Sheldon decided to accept his cousin’s offer to live with him while in school. When he graduated, Sheldon made a promise to pay his cousin $475.00 a week for all the time he had lived there. Later, due to financial troubles, Sheldon refused to pay his cousin. Sheldon’s promise to his cousin:

Is enforceable because prior consideration is a valid form of consideration.

Is enforceable because of the preexisting obligation rules

Is not enforceable because his promise to pay $475.00 a week came after the bargain and past consideration is not valid.

Is not enforceable because $475.00 is probably not equal to the amount he really should pay his cousin; a fair rental amount would be 600.00/month.

Is enforceable because of quasi contract

2. At the start of the academic year, Professor Debit announced to his class that he would pay the cost of a graduate review class (such as Kaplan) for the student who received the    highest grade in the Professor’s class. This offer was written and posted on Blackboard. Amanda Dogood, a student in the class, told the professor she intended to win the prize

Amanda’s conversation with the Professor has no legal affect since his statement is not a valid offer.

The Professor’s statement is unconscionable and void.

None of the above.

The Professor’s statement is a unilateral offer and can only be accepted by performance so it can’t be accepted till the end of the semester.
