Patricia Boen, the associate of Black, White and Greene, was on trial on a complicated real estate litigation matter. She was in the process of examination when the opposing party gave a different answer than had stated in his interrogatories. Ms. Boen, in an attempt to impeach his testimony, indicated that his interrogatory answers were contrary to his current testimony. She grabbed the file to find the interrogatories The file was neither indexed nor organized, and Ms. Boen could not find the interrogatories. Five minutes passed as Ms. Boen thumbed through the file. The judge and jury watched her in silence. She stated that the interrogatories must be in another file and picked up another file to search for the interrogatories. As she did, 20 to 30 small hone message slips fell out of the file and scattered all over the courtroom floor then continued to search the file for the interrogatories. Needless to say, the judge, the jury, and her client were not impressed.
