Case Background

This assessment is to help you with your legal research, interpretive and writing skills. This assignment will be examining SILO's 1, 2, 3 and 4:

Law is as much about communication as it is about knowledge of the law. Unless you can clearly communicate complex technical arguments your knowledge of the law will be severely restricted in imparting that knowledge to employers, clients or other interested parties. Once you have mastered the skill of technical writing the contents of the legal topic are located via research. You are then required to interpret the material you have located to determine that part which is pertinent to your specific research question.

The assignment is divided into two (2) tasks as provided below:

The first is to explain the question thoroughly. It is very important to provide reference of the sources that you have used to answer the question.

The second task asks you to discuss the answer with relevant references to support your arguments. You are encouraged to use legal terminology in your discussion. It may sound like an easy task; it is in-fact quite difficult and requires you to think laterally.

This task also requires you to answer the questions using your research skills.

Question (a) are you able to explain how the law can be made by parliament and through court decisions?are you able to comment on the effectiveness of these two methods of law making?

Question (b)  are you able to explain one reason why we have a court hierarchy? Explain your answer with a case law
