Some political leaders and pundits in the US claim that medical malpractice insurance and specious tort claims against providers are driving up the costs of health care in this country and that legal reform is necessary. Others counter by arguing that a victim of negligence or malfeasance is entitled to be “made whole,” regardless of whether their injuries were inflicted by a drunk driver or a doctor. Is tort reform needed? Why or why not? If so, what types of measures would you recommend? If not, what would you recommend as a strategy for reducing claims and premium costs?
