Chandler, Joey and Ross are partners in a small general partnership that operates a coffee shop. Joey and Ross manage the coffee shop while Chandler is primarily an investor who spends little time at the coffee shop. Ross is accused of sexually harassing Rachel, a waitress receptionist at the coffee shop. Rachel claims Ross touched her inappropriately, made lewd and vulgar remarks in her presence, and made unwanted sexual advances to her. When Rachel told Ross to stop, Ross fired her. Joey and Chandler knew nothing about the alleged harassment. Rachel sued Ross, Chandler and Joey for damages due to sexual harassment. A jury awarded Rachel damages in the amount of $500,000. The coffee shop has operated at a loss for the past 2 years and has no assets to satisfy the jury award. Ross and Joey also have no money or assets to satisfy the judgment. Rachel tries to collect the $500,000 from Chandler. Can Chandler be held liable to Rachel for Ross's actions when he had absolutely no participation in or knowledge of Ross's actions?
