Nathaniel Melendez and Chris Williams hosted a cookout at their home in Florida, inviting many business acquaintances. One guest was Isabella Iberra, a nineteen-year-old. Alcoholic beverages were served at the party to all of the guests, even those who, like Iberra, were between the ages of eighteen and twenty-one. Iberra consumed alcohol at the party and left with other guests. One of these guests detained Iberra at the guest's home to give Iberra time to "sober up." Iberra then drove from the guest's home and was killed in a one-car accident. At the time of death, Iberra had a blood alcohol content of .292 percent, which exceeds the state's limit for driving a motor vehicle. Nila Iberra, Isabella's mother, filed a suit in Florida state court against Melendez and Williams, and others alleging negligence.
