"Just Widgets" was a thriving business that wanted a workplace free from all forms of sexual harassment. "Just Widgets" wrote guidelines for its workers that specifically forbade sexual harassment. The guidelines included: (1) examples of conduct that would not be tolerated (2) possible penalties (3) the name of a company official who would be the proper person to whom complaints should be brought (4) a policy of investigating complaints thoroughly, and (4) an educational policy designed to remind employees of the policy.

Emerson made a complaint of sexual harassment charging his supervisor had demanded sexual favors. An investigation was made, and the charge was substantiated. The supervisor was warned not to continue this conduct, but it happened again. The supervisor was again issued a warning. Finally, Emerson brought a court action against the supervisor and "Just Widgets." "Just Widgets" defended claiming it had done all in its power to rectify the situation. How is the court likely to decide?
