Fanny and Henry faced a problem with the bedding that Fanny ordered. She ordered in writing 250 sheets, 100” by 96,” per a catalog from Hotel Supplier. Hotel Supplier is a wholesaler specializing in catering to hotels and motels. Unfortunately, Hotel Supplier did not have the sheets in stock and sent 250 sheets 95” by 88.” The wholesaler is aware that the order came from a B and B since Fanny ordered the sheets on the B and B letterhead stationery. The wholesaler knew that in the trade, the smaller sized sheets worked fine in most instances, and that many in the trade thought the two sizes were virtually interchangeable. The sheets arrived at the B and B in a timely fashion, and indeed, arrived two weeks early. Answer each of the following questions, which are based on the foregoing information. Each answer must be separate and distinct, with a blank space between each answer. 5a. What rights does Fanny have regarding the shipment that Hotel Supplier shipped? 5b. What rights does the wholesaler have? 5c. Would it make any difference if, after Fanny and Henry talked over the problem of the smaller sheets that they went ahead and used a couple dozen of them anyway? Answer the question without using the words “yes” or “no.” 5d. What does Hotel Supplier need to do in order to make its shipment of the smaller sheets a counter offer to the B and B’s order for the larger sheets? Explain 5e.
