It is concerning that some employees, including myself, have not received salaries for over four months. This situation, exacerbated by the financial and operational difficulties faced by the business, has significant implications. It appears to be neither a dismissal nor a suspension due to misconduct, as those would necessitate due process. It also does not seem to be a unilateral termination initiated by the employee.
Your offer of a mutual separation suggests the need for a formal discussion to agree on the terms of separation. However, despite my attempts to meet with Ruth Jephthah from HR, I received an impression that Educor is not inclined to have such discussions and would prefer that I simply depart without resolution, as have many of my colleagues.
This approach feels inconsistent with professional standards and respectful employee relations, particularly given that salary payments are overdue through no fault of the employees but rather as a result of management challenges.
If there is another classification that explains the non-payment of salaries, I would appreciate your guidance. However, without this, I maintain the situation aligns with what could be considered retrenchment. I therefore respectfully request a retrenchment letter, as this will enable me to address my loan insurance claim effectively.
I was to refer above dispute to CCMA as a retrenchment without following proper procedure.
