In 1978, the United States supreme court ruled that tribal courts did not have jurisdiction to prosecute non-Native Americans for crimes that took place on Indian land. Consequently, for any crime that involves a non-Indian defendant, jurisdiction rests with either the federal government or, in several states, the state government. In practice, according to Fred Urbina, the attorney general for the Pascua Yaqui tribe of Arizona, federal authorities are unlikely to seek conviction in these instances unless there has been a "major crime".
