Question

March, Michael hires Regina to be a financial advisor for six months in return for a salary of $10,000 monthly for a total of $60,000. During the first three months, Regina does an excellent job, and Michael pays her salary for each month -a total of $30,000. However, at the three-month mark, there is a downturn in the stock market, which stresses the profitability of Michael's firm. Because of the downturn, Michael terminated Regina's employment at the end of the three-month period. Michael tells Regina, "It is impossible for me to keep you. We have to cut costs, or we may not profit this year. Regina immediately tries to find another job as a financial advisor but is unable to secure a position during the remaining three months of the contract. Regina brings a breach of contract claim against Michael for the remainder of the money owed under the agreement. Michael tries to avoid liability by pleading both impossibility and impracticability. How would a court analyze the issues? Would a court relieve Michael of liability?
