ACME pharmaceuticals makes a hair growth drug called “Rugmax.” This drug, when taken properly, is designed to stimulate hair cells in the scalp for a more thicker hairline. On the drug container is a warning: NOT FOR FEMALE USE. Harry and Henrietta are married, and Harry received a prescription for the drug. He threw away the box that contained the warning. Henrietta took the drug and grew hair on the tops of her feet. Can she sue ACME pharmaceuticals? Why or why not?
