Paula recently moved to the State of Aurora with her young son, Sam. The local School District has two elementary schools with kindergarten programs. School A is within a short walk of Paula's home while School B is a 30 minute drive away from her home. Paula sought to enroll Sam in School A but was turned away. The School District advised her that School A had recently achieved unitariness as a fully integrated school, so admitting Sam would contribute to racial imbalance at School A. But admitting Sam to School B would further its efforts at desegregation and it is a magnet school that feeds into an academically enriched secondary school system from which the prestigious Aurora College of Science & Medicine draws most of its applicants. Under Aurora's guardian ad litem laws, Paula can assert the legal rights of Sam as she is his custodial parent. Paula brings an action in federal court to enjoin the School District from enforcing its school assignment decision.
