Neurology Associates, LLP v. Elizabeth Blackwell is a very interesting case because the cards seemed to be stacked against Elizabeth Blackwell but to me she was the root of all her problems. She should not have caved in to Cohn’s demand to ask questions later. Elizabeth Blackwell simply signed away her life by not having a lawyer look over the documents that Cohn wanted her to sign. Blackwell signed the document and committed to a work load that was seemingly less ending. A court would look at the enforceability of that contract. Now a employment contract my hold convening stipulations to conserve an employers interest. These restrictions may keep an employee from working within a certain distance, away from the prior employer, for a certain amount of time after employment termination. Neurology Associates provided money and specialized training that benefited Neurology Associates and Elizabeth Blackwell. Now, Neurology Associates granted the paid leave of Elizabeth Blackwell for her board certification in neurology. There was a shortage of neurologists in the southwest region of Longville equivalent to demand and competition in business rising. Elizabeth signed the document presented by Neurology Associates agreeing for a period of three years after leaving the company that she would contract with any neurological service providers in the restricted Longville area.
