Facts: Miller listed her home for sale. On August 4th, Norman made an offer, specifying that it must be accepted by 5:00 p.m. on August 5th. Miller received the offer, made several changes, signed it, and returned it to Norman. Norman did not respond. On August 5th at noon, Segal offered to buy Miller's house and Miller accepted. Miller then revoked the counteroffer to Norman. But right before 5:00 p.m., Norman initialed Miller's counteroffer and delivered it with a deposit. To whom, if anyone, did Miller sell her home?
Issue: Is the Counteroffer still valid after it was revoked?
Decision: The counteroffer is not valid, Miller hadn't sold her house to Norman. Whether or not she has sold it to Segal already is unknown.
Reasoning: Miller submitted a counter offer to Norman originally but revoked it before the said deadline "5Pm" making Normans offer invalid. Legally once any offer is revoked it is invalid. Miller hasn't sold her house yet to Segal either assuming that they haven't gone through the proper legal process yet.
