Solly is a businessman.Morty has a restaurant. Solly wants to hire the morty's restaurant.Morty gives Solly a standard contracts with all her tenants. Solly reads the terms in the contract and notices that they say nothing about the state of the kitchens in Morty's premises.if everything is not perfect as Morty said,solly may not rent this restaurant.however, when Solly moves into the premises one week later he discovers that the kitchen is quite dilapidated, that only one out the three ovens work. Solly is upset, accuses Morty of lying to him and wants to terminate the contract and obtain damages because he will have to spend a considerable amount of money to fix these problems if he's going to have a working kitchen for his restaurant in time for opening. Morty says he had no idea at the time of entering into the contract that the kitchen was in such a bad state. Morty blames the previous restaurant tenants for ruining the kitchen and says "When the previous tenants left they gave me a copy of their report on leaving the premises stating that when they left the kitchen was clean and all the equipment was in good working order. So morty believed that. he had no idea that it was not true". Advise Solly whether he can terminate this contract and make a claim for damages under contract law against Morty? Or not?
