Appeals

The judge's decision may be appealed to the Court of King's Bench. To appeal a Judgment of the small claims court, the Appellant (appealing party) must:

Within 30 days of the judgment, prepare to file a Notice of Appeal (serving the Notice on the respondents) and order a transcript of the evidence.

Within 37 days of the judgment, file copies of the Notice of Appeal and transcript order/invoice, with Affidavit of Service.

Within 3 months of filing the Notice of Appeal, file the transcript of evidence.

Once these steps have been taken, the Clerk will send out notice of the hearing date.
