Brothers Larry, Darryl, and their other brother Darryl call the local Best Buy and get a quote on an oversized HDTV for twenty-two fifty. They tell the clerk, "Hold it, we're coming with money in hand!" When they arrive at the store, the clerk rings up a purchase for $2,250, and Larry, Darryl, and their other brother Darryl nearly fall out of their socks! (They thought they heard $22.50.) After some thinking, they threaten to sue the store, claiming they had an enforceable contract and the store is in breach. They demand to speak to the manager.
After listening to the brothers yelling, the exasperated store clerk pages the store manager over the speaker system and states, "Store manager to the TV section; three idiots waiting for service." Store customers come by, and when the clerk tells the story, customers laugh hysterically and jeer at the brothers. Darryl is crying. The other brother Darryl puts a bag over his head to try to hide.
i. As the store manager, it is up to you to explain Contracts 101 to the brothers. What arguments can you make for why your store should not have to sell them a $2,250.00 TV for $22.50? Explain.
ii. Could Best Buy be liable when the brothers sue for the tort of intentional infliction of emotional distress because they were publicly ridiculed? Under what theory?
