Article 79 of Convention on Sale of Goods provides with the exemption of performance of contract by the obligator. Such exemption is granted on the basis of "impediment" ,unforeseeable circumstances and such circumstances are beyond the control of the obligator. The word "impediment" is not inclusive of hardships on the ground that parties to contracts are aware of the risks and uncertainties during International trade. Therefore, the Courts and Arbitration Tribunals have set the doorway of this exemption extremely high which makes Article 79 remote in it's application.However, in handful number of cases exemption has been granted on basis of hardships. Article 79 makes it clear that exemption does not repudiate the contract rather no performance shall be done till impediment persists. Exemption granted does not affect the other rights of the aggrieved other than to claim damages.
