2. Able intends to offer Baker a job. Able tells Charlie that she intends to make the offer and tells Charlie all the specific information that would be included in the offer. Charlie, on his own with no instruction from Able, tells Baker what Able is proposing. Baker calls Able and accepts the job. In the meantime Able has reconsidered and does not want to hire Baker. Baker sues Able for breach of contract. Who wins? If Able told Charlie to tell Baker about the offer does that change the result?

3. Alan offers to sell his house to Barbara for $1 million. The offer is a valid offer. Before Barbara accepts the offer, Carly calls Alan and tells Alan that she would like to buy the house for $1.5 million. Alan sends Barbara a revocation of the offer by regular (snail) mail. Before Barbara receives the letter of revocation, Barbara sends an E-mail to Alan accepting the offer to buy the house. Of course, Alan refuses to sell the house to Barbara so Barbara sues Alan. Who wins? Why?

4. Samson is hit by a car driven by Delilah. Samson is willing and makes an offer to settle the lawsuit against Delilah with Delilah’s insurance carrier for $50,000. Delilah’s insurance company agrees to the settlement, and sends Samson a check for $50,000. However they tell Samson that Samson must leave the money in an escrow account for a month to satisfy any liens against the auto. That means that Samson can’t touch the money for a month. Samson gets infuriated and rips up the check, and sues Delilah for $150,000. Delilah and the insurance company argue that Samson has already settled the suit and is barred from bringing the action. Who wins? Why? Who, how and when are offers accepted?
